Gift Cards
Terms & Conditions

1. General

These Terms & Conditions govern the issuance and use of gift cards and gift cards (“Gift Cards”) made available to users (“Users”) through the ScanRewards platform (the “Platform”). Gift cards are provided as a reward in exchange for the completion of certain actions on the Platform, including but not limited to uploading purchase receipts and completing surveys or questionnaires.By receiving and using a Gift card, the User acknowledges having read and accepted these Terms & Conditions.

2. Nature of the Gift cards

Gift cards are digital gift cards issued by third-party brands or retailers, including but not limited to Amazon, Zalando, Fnac Darty, and Decathlon (the “Partners”). NielsenIQ acts solely as an intermediary facilitating access to these gift cards and is not the issuer of the Gift cards. Each Gift card is subject to the specific terms and conditions of the issuing Partner, including but not limited to:
- validity period / expiration date,
- eligible products or services,
- geographical restrictions,
- conditions of use and redemption.

3. Gift card Value

Gift cards are available in various denominations, typically ranging from €5 to €50, depending on availability and the type of action completed by the User. Gift cards values cannot be exchanged for cash, refunded, or converted into any other form of compensation.

4. Earning and Delivery of Gift cards

Gift cards are granted once the User has:
- completed the required action(s) on the Platform, and
- complied with all applicable rules, including accuracy and authenticity of submitted information.
NielsenIQ reserves the right to verify submissions and to refuse, suspend, or cancel the delivery of a gift cards in case of suspected fraud, misuse, or non-compliance with these Terms. Gift cards are delivered digitally, usually via the Platform or by email, within a reasonable timeframe after validation.

5. Use of Gift cards

Gift cards may only be used:
- in accordance with the issuing Partner’s terms and conditions,
- within their validity period,
- for personal, non-commercial use.
Gift cards are non-transferable, non-resalable, and may not be reproduced. Once redeemed, a gift card cannot be reissued, even in case of loss, theft, deletion, or accidental use.

6. Expiration

Each gift card has a fixed expiration date determined by the issuing Partner.
[NielsenIQ shall not be responsible for:
- expired gift cards,
- unused balances,
- any loss resulting from failure to redeem a gift card before its expiration date.
Users are solely responsible for checking and complying with the validity period of their gift cards.

7. Limitation of Liability

NielsenIQ does not guarantee:
- the availability of gift cards at all times,
- the uninterrupted operation of Partner services,
- the acceptance of a gift card by a Partner in case of misuse or violation of Partner terms.
NielsenIQ shall not be held liable for:
- refusal of a gift card by a Partner,
- modification or termination of a gift card program by a Partner,
- technical issues or errors occurring on the Partner’s systems.
Any claim related to the use of a gift card must be addressed directly to the issuing Partner.

8. Fraud and Abuse

Any attempt to obtain gift cards through fraudulent means, including but not limited to:
- falsified receipts,
- duplicate submissions,
- false information,
- automated or abusive behavior,
may result in immediate suspension or termination of the User’s account and forfeiture of any pending or issued gift cards, without compensation.

9. Modification of the Terms

NielsenIQ reserves the right to modify these Terms & Conditions at any time.
Any changes will be effective upon publication on the Platform. Continued use of the Platform and gift cards after such changes constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the local laws.
Any dispute arising in connection with these Terms shall fall under the exclusive jurisdiction of the competent courts of France or Germany, unless mandatory consumer protection rules provide otherwise.
